Conrad Murray Asks For Appeal In Michael Jackson Manslaughter Case

Murray is asking appellate court to re-test a piece of medical evidence from his trial.

<P>The imprisoned cardiologist <a href="/news/articles/1673906/michael-jackson-conrad-murray-verdict-guilty-involuntary-manslaughter.jhtml">convicted of manslaughter</a>&#8232; in the 2009 death of <a href="http://www.mtv.com/music/artist/jackson_michael/artist.jhtml">Michael Jackson</a> filed a request on Monday to have a key piece of evidence in his trial re-tested. Dr. Conrad Murray is asking an appellate court to order a lab to authorize a forensic analysis on residue in a drug vial taken from the bedroom of Jackson's rented Los Angeles estate.</P><P>According to the <a href="http://www.latimes.com/news/local/la-me-0731-murray-20120731,0,2898322.story" target="_blank"><I>Los Angeles Times</I></a> Murray's defense team thinks that the 100-milliliter bottle, which was a key piece of evidence at the 2011 trial that ended with Murray's conviction on involuntary manslaughter charges, could help lead to a successful appeal of the sentence.</P><P>Murray's fingerprint was on the bottle, which prosecutors said held the lethal dose of the surgical anesthetic propofol that killed Jackson. Prosecutors had argued that Murray mixed a small amount of propofol with another anesthetic, lidocaine, in an intravenous drip and then left Jackson unattended.</P><P>Murray's defense team said the vial was in a bag of trash and was unrelated to Jackson's death, countering that the pop icon injected himself with propofol from a syringe while the doctor wasn't looking.</P><P>"If a forensic examination of the residue in Exhibit 30 revealed no lidocaine, it would completely negate [the prosecution expert's] concluding theory ... leaving only the theory of bolus injection just prior to Jackson's death," appellate attorney Valerie Wass wrote in a filing.</P><P>This is the third time Murray's lawyers have attempted to launch an appeal on these grounds after they argued that they did not fully comprehend the need to test the residue until the testimony of a prosecution expert near the end of the seven-week trial. During the trial, judge Michael Pastor refused a motion for further analysis shortly after the verdict; a second request was also denied.</P><P>Murray, 58, received a four-year sentence but is not expected to serve more than two years in county jail.</p>

Labor Dept. says no need for warning on layoffs

WASHINGTON (AP) ? The Labor Department said Monday that federal contractors do not have to warn their employees about potential layoffs from across-the-board budget cuts that could begin on Jan. 2.

In a guidance letter, the agency said it would be "inappropriate" for employers to send such warnings because it is still speculative if and where the $110 billion in automatic cuts might occur. About half the cuts would be in defense.

The letter comes days after a Pentagon official said Defense Department contractors could be sending their workers layoff notices four days before the Nov. 6 presidential election. That prospect has unnerved the White House because it would affect thousands of defense workers in presidential battleground states such as Florida, North Carolina and Virginia.

Under the federal Worker Adjustment and Retraining Notification Act, employers of companies with 100 workers or more are required to provide notice 60 days in advance of a plant closing or mass layoffs.

But the Labor Department letter says federal agencies have not announced which contracts might be affected by the budget cuts ? known in Washington as sequestration ? so any plant closings or layoffs such cutbacks are "speculative and unforeseeable." It also points out that lawmakers are trying to avert the cuts, which would avoid layoffs altogether.

The letter was sent to state workforce agencies which help laid off workers find new jobs or get additional training.

The GOP chairman of House Armed Services Committee claimed the new guidance was politically motivated.

"People will still get laid off because of the president's irresponsibility, but they won't have the notice to protect themselves and their families," California Rep. Buck McKeon said.

The guidance comes as major defense contractors are bracing for the possibility of mass layoffs. Lockheed Martin, for example, has told Congress that across-the-board reductions could result in layoffs of 10,000 employees out of the company's 120,000 workers.

The military will face a reduction of $492 billion over a decade, with a $55 billion cut beginning in January, unless Obama and congressional Republicans and Democrats can agree on a plan to avert the cuts. Domestic programs also would be reduced by $492 billion over 10 years.

The automatic cuts are slated to take effect because of the failure last year of a bipartisan congressional panel to come up with a plan to cut the deficit by $1.2 trillion over 10 years.

?1. QR Codes

Imagine a hyperlink, except instead of actual readable text that you can type in, it's some weird ziggurat that gives no hint of where it's going. Also, instead of clicking on it, you have to take a picture of it with your camera, and you're probably going to have to take that picture three or four times before it works, and a lot of the time it's going to send you to either a non-mobile site or a dead link. If they all disappeared tomorrow, not one person in the entire world would care, not at all.

2. Routers

For some reason, they all look like they were made in 1995 and most of them act that way too. Everything they do would be much better in a scaled down, Airport-Express-style dongle. Time to burn this one down and start again.

3. Browser plugins

Flash is pulling out of the mobile world (after years of trying to break in) and Silverlight is ruining lives on a daily basis. Soon HTML5 will replace them entirely ? browser plugins don't exist on the iPhone or iPad and they won't exist on Windows 8 RT ?? but in the meantime there are a lot of websites with gaping holes in them, like a newspaper attacked by old lady clipping coupons.

4. Traffic cameras

The?rule was, if a cop caught you speeding, you got a ticket. It was a great system, both for the Smokey-and-the-Bandit factor and because, if you were only a little bit over the line, the officer would usually let it slide. Mailing tickets to people just because they got from point A to point B a little ahead of the curve is cheating, and it moves us towards a creepy automotive panopticon where the force of law is both intangible and omnipresent. But mostly, it's just lame.

5. Inductive charging?

Another idea that's been kicking around for a while without ever taking off. If it's not built into the phone, like the Palm Pre, it's not any easier than plugging it in.

6. Bluetooth audio

This started out as a good idea ? especially the speakers ? but it took 15 years to produce a decent product. Time to call it a day. We're better off with speaker wire.

7. The remote control

True story: I recently visited a friend who was housesitting, and it took us 10 minutes to figure out how to turn on the TV. There were three remotes, and each one had 40 buttons on it, except for the Apple TV remote, which didn't have a power button. Just put it in an app.

8. The cable box?

Speaking of which, here's a strange box that requires another remote control. Destroy! Or get it over with and shove it inside of an?Xbox or Apple TV already.

9. Software license keys?

Hard to enter, easy to crack. Authentication shouldn't be this difficult.

10. Cables For everything

Too many cables. Toomanycables. Too many, cables. Too.?Many cables.

11. The printer/scanner/fax

A surprising number of people still get one of these when they buy a computer, even though there's no reason to do any of these three things, and if you ever run out of ink or toner you will suffer the tortures of the damned. The sooner we stop expecting paper copies of things, the better.

12. Blu-Ray?

A lot of loose copies of Transformers 3 were handed out trying to make this one happen. And the movie looked great! Unfortunately, nobody you know owns a Blu-Ray player, and nobody wants to make a computer that deals with them. You're better off streaming.

13. The power brick

It's enough to make you wish we'd stuck with direct current.

14. Facebook comments

Designed to bring civility to web comments by attaching real people's names to them. Because if you know Richard Morris here is the person saying crazy things, he won't say them, right? Wrong. It continues to be a bottomless will of spiritual death and plain-old web-design misery.

15. Standalone anti-virus software?

It's crazy that this still exists. Just bake it into the OS already.

Oh No They Didn&#39;t! - Has Image Overtaken Music?


(CNN) -- Is Lady Gaga an artist?

Sure, she can play piano. She's got some songwriting talent, too. But music isn't what comes to mind when the former Stefani Germanotta is discussed. Instead, it's the attention-getting antics: The controversial videos. The in-your-face sexuality. The crazy concerts. The meat dress.

Is it about the music, or the Fame Monster?

Rachel Weingarten wonders.

"I don't consider Gaga an artist," the New York style consultant says, then reconsiders. "Well, maybe she's an artist for our time. Every generation gets the artist it deserves."
If that's the case, Gaga has a lot of company.

"They want to be famous, not make music," says Lyndsey Parker, managing editor of Yahoo! Music, of some of the new breed. "The music is just one facet of the celebrity."

It's an indicator of societal shifts, she says. Now you can upload a video and receive immediate fame. So much for learning three chords and working your way up the ladder.

"Now everyone expects overnight success, whether it's because someone discovered your video on YouTube, or you went on a reality show," she says.

Has the gimmickry gone too far? Have we become numb to the emotion and the power of music? The stuff used to be about something, dammit, not a soundalike drone of manufactured robots, lip-synching amid falling tinsel.

Right?

Art and authenticity

Well, they call it "show business" for a reason.

Previous generations made less of a distinction between art and entertainment, observes Georgia Tech professor Philip Auslander.

"In the '40s, and I believe well into the '50s and the rock 'n' roll era, the idea of what it was to be a musician wasn't as pure and pristine as we seem to want to think of it now," says Auslander, who's written a study of glam rock. "The idea that to be a popular musician is not just to stand up there and show off your ability as a musician, but to entertain in other senses -- that was very much a staple of what popular music performance was about."

Even the Beatles, who became much more decorous performers after Beatlemania hit, dominated the local scene during their Hamburg residency by turning up the volume, smashing stages and -- in a famous incident -- doing a show with John Lennon in his underwear, wearing a toilet seat around his neck.

Of course, pop musicians have long been as much about entertainment as art -- but as times have changed, so have perceptions of where the line is drawn. To critics, MTV -- which arrived in the 1980s -- heightened the value of looks and slickness over "authenticity," with the image becoming more important than the music. And nowadays, in our 24/7 world of rapidly posted YouTube videos, instant MP3 releases, reality shows, lurking paparazzi and meat dress one-upmanship, it's easier than ever for spectacle to overwhelm singing.

It can be a false divide -- a glitzy video or elaborate stage show doesn't mean the performer can't play -- but it's one that's come to define some of the differences between rock and pop, says Auslander.

"I think a lot of this stuff is specific to particular genres and subgenres of music, and the old distinction between rock and pop, where the people on the pop side are not expected to be authentic in the same way as the people on the rock side," he says.

It's what's led to the so-called "rockist" point of view, he adds: that rock, which was album-oriented and ranged from earnest singer-songwriters to classically inspired progressive bands, was somehow superior to pop, which was found on singles and included bubblegum, disco, easy-listening and anything else likely to make the Top 40. Nowadays the genres are more blurred, but the prejudices remain: Rock is Serious and therefore Art; pop is unserious and therefore ephemeral.

It's a distinction that's long been disdained by performers themselves. As the old dictum, variously attributed to Louis Armstrong or Duke Ellington, states: "There are only two kinds of music: good and bad."

"I love a show. I want to be entertained," says Matchbox Twenty's guitarist, Paul Doucette, who praises the energy Lady Gaga brings to her concerts (and observes that "she can back it up" with her talent). "Don't get up there and look like you're not having a good time. I've seen enough of the shoegazing in my life. I want fun back in rock."

A new road to fame

The same goes for Flaming Lips frontman Wayne Coyne, whose band has been known to put on a show themselves -- complete with avant-garde, big-screen visuals, falling balloons and a giant "space bubble," a transparent ball containing Coyne from which he walks over the crowd.

"That's part of the fun of being in a rock band," he says. "If you're lucky, you get to create an image."

And as for the image overwhelming the rest of it, he points out that, if he's done his job right, every element works together so that the band and audience are satisfied. When this interview was conducted, the Lips were about to attempt to break the Guinness world record for most live concerts in 24 hours -- an arrangement that, despite the stunt aspects, the Lips were taking as seriously as any individual show.

"People are going to pay real money, people are going to give us a lot of their time, so we don't want it to be just hype -- it's really got to be great," he says. (For the record, the band got its record.)

Coyne has an open-minded view about what characterizes "art."

On the Lips' latest CD, "The Flaming Lips and Heady Fwends," the guests include such indie favorites as Nick Cave and Bon Iver, as well as Ke$ha, the "Tik Tok" pop rapper disdained by the music press ("a faceless, anonymous pre-fabrication of a pop star," wrote Slant's Jonathan Keefe).

"I think the world can have all kinds of things in it, and just because someone is popular doesn't mean they're more important in people's minds," Coyne says. "(The audience) should pick what they think is speaking to them the most. If that's a Lady Gaga, great for you. If that's an obscure little artist that you know in your hometown, use that.

"But," he adds, "it's very difficult to resist the temptation of popularity. Everybody likes it. These are all dynamics everybody struggles with. What art does, it lets you be free. There should be no judgment about you in that." He audibly shrugs. "But this is not the way people use music in the world."

It's those divides -- between popular and niche, between wealthy celebrity and starving obscurity -- that keep injecting themselves into debates about music. Moreover, now that the music business has been turned upside-down by technology, musicians must find their own path to exposure (which, presumably, is still the point).

"The whole idea of a top-down market is gone," says David Herlihy, a music and law professor at Boston's Northeastern University.

When his own band was on the circuit in the 1980s, there was a "road map," he says, one that had existed for a generation.

"You needed the record label. You needed to go to the recording studio. You needed to get on the radio. You needed to be in record stores. You needed all these intermediaries. Everybody I ever became aware of followed that map," he says. "And now technology has completely disintermediated the business, and so now you have music and art, and people who consume those things directly. Therefore, it can go anywhere."

The starving artist's dilemma

It's tremendously freeing for an artist, and also a little scary.

Do you market directly to fans, the way someone such as Josh Rouse does? Do you make arrangements to license your work, the way Moby did? Do you make yourself into a brand, a la Madonna -- who's veered so far into pure celebrity, Yahoo's Parker says, that she and her colleagues couldn't figure out whether to classify a Madonna story as "music" or "celebrity news"? Do you work with advertisers, extending your identity to other products and essentially using music as a platform to other things?

It's not necessarily a new idea -- the Beatles, after all, once had a clothing store -- "a beautiful place where beautiful people can buy beautiful things," Paul McCartney said at the time -- but the concept has reached new heights in our free-for-all age.

Paul Greco, the director of music for advertising giant JWT, is responsible for putting musicians and their songs together with advertisers. "You knew there was selling out, and then there was punk rock," he says. (Deily now works in the advertising business.)

"Sell-out" doesn't come up much anymore, says Greco. "Musicians are artists. But they don't need to be starving artists," he says. "You have to make a living."

Band management

Matchbox Twenty's Doucette has seen all sides of the equation. His band has played bars and stadiums, has been groomed by a record label and succeeded in the post-label era. Lead singer Rob Thomas has been a paparazzi magnet.

Doucette says that commercialization comes with the territory.

"A band is a brand. It sells music, it sells image, a lot of things. This is our product, this is what we do. The fact it has artistic integrity is what separates it," he says. "The difference is where the emphasis is."

For Doucette, the problem arises when music isn't the point.

"It does seem like there's a little bit of, I want to become famous, then have a perfume line, make a record, be on a reality show. It's more about being famous than it is about wanting to do music because that's what you do, and then that opening you up to other possibilities. It depends on what your intention is."

But, he acknowledges, these are strange times for music.

"We're still in the Wild West of all this," he says. "People are still trying to figure out, how do people experience music now? There are so many different ways to do it, and how do you make that work? All these things fall into that -- the branding, the image, the importance of radio -- they're all connected."

In the meantime, when it comes to public tastes and media coverage, the pendulum swings forward and the pendulum swings back.

Perhaps the most successful musician of the past year is the pianist Adele, whose performing and songwriting are equally personal and unadorned -- a throwback to the early '70s singer-songwriters, or perhaps Norah Jones and Alicia Keys. "Eventually Lady Gaga's not going to be able to wear the meat dress," he says. "But she's not going to have a problem, because she's been, like, I can do this. And when (she) gives you a regular song, that's going to be as shocking as the meat dress, with her sitting there at the piano with no crazy hat on."

Smartphones power record Samsung profit of $5.9 billion during Apple lull

SEOUL (Reuters) - Samsung Electronics Co, the world's top technology firm by revenue, reported on Friday a record operating profit of $5.9 billion for the June quarter, as rampant Galaxy S handset sales helped stretch its lead over Apple Inc.

Shares in Samsung, which also makes TVs and other appliances, flat-screens, and chips, jumped as much as 4.7 percent to a five-week high after the results, outperforming the wider market.

"Solid results from the TV division show its resilience to the euro zone crisis, while the mobile division has become a strong cash cow on the back of strong Galaxy sales," said Seo Won-seok, an analyst at Korea Investment & Securities.

"Weak memory chip prices remain the biggest concern for Samsung in the third quarter, but it will again fare better than rivals as its reliance on Apple, which tends to squeeze suppliers quite a bit, is small compared to the likes of Hynix and Toshiba. It'll have less margin pressure."

JK Shin, head of Samsung's telecoms business, told Reuters on Sunday that sales of the Galaxy S III, the most aggressive competitor to the iPhone, were better than his initial forecast of at least 10 million units in the first two months after its launch in late May.

It is also preparing a sequel to the popular phone-cum-tablet Galaxy Note later this year to counter Apple's new product releases.

Samsung, which earlier this year ended Nokia's 14-year reign as the top global handset maker, is estimated to have increased smartphone shipments to 50.5 million in the June quarter, nearly double the 26 million iPhones sold.

Apple shipments in the June quarter tumbled 26 percent sequentially as the European economy sagged and consumers held off on buying ahead of the release of the iPhone 5.

"Regardless of Apple's performance, Samsung will be strong in the third quarter," said Byun Han-joon, an analyst at KB Investment & Securities. "Actually, for Samsung, Apple's stumble is a chance."

Analysts estimated that Samsung, which now controls more than a third of the global smartphone market, will sell 15 million to 20 million of its Galaxy S III in the September quarter.

PATENT BATTLE

Samsung, valued at $160 billion and the world's leading maker of TVs, said April-June operating profit totaled 6.72 trillion won ($5.9 billion), in line with guidance it issued earlier this month.

That is up 79 percent from a year ago and 15 percent from the previous record - 5.85 trillion won in the March quarter.

Still, its net profit of 5.2 trillion won ($4.5 billion) is only half of the $8.8 billion Apple returned in the last quarter from its iPhone, iPad and Mac computer sales.

Samsung's gross margin of 37 percent also lags Apple's 43 percent.

The two technology giants, locked in bruising patent battle globally, will begin a jury trial in federal court in San Jose, California on Monday. Apple seeks roughly $2.5 billion in damages, plus permanent injunctions on some Samsung phones and tablets, while Samsung is demanding patent royalty payments.

Samsung said it expected its third quarter - July to September - to be marginally positive as demand for consumer electronic goods, including smartphones and tablets remains strong.

However, it said it expected weak demand for PC DRAM to continue in the third quarter.

Song Myung-sub, a senior analyst at HI Investment & Securities, said chip earnings might pull back slightly in the third quarter.

"But the increase in demand for its products from Microsoft Windows 8 release in September and the iPhone in October will bring demand higher than supply," Song said.

Profit from the telecoms division more than doubled to 4.19 trillion won from a year earlier 1.71 trillion won, with sales of 50.5 million smartphones - or 380 every minute.

Its semiconductor business showed a small decline in profit to 1.1 trillion won from 1.79 trillion won, following weak demand for NAND memory chips and computer memory chips.

Prices of NAND flash memory chips tumbled 46 percent in the first half of this year following a 34 percent plunge last year, forcing Toshiba Corp to cut output by 30 percent.

The flat screen division swung to a small profit of 750 billion won from a year earlier loss of 210 billion won after a global fall in LCD (liquid crystal display) prices stabilized.

The TV and home appliances business returned 760 billion won, up from 470 billion won. Analysts have said the business has been buoyed by solid sales of high-end TV models with 3D and Internet connectivity features.

While the next iPhone will likely slow Samsung's handset earnings growth, it will boost the Korean firm's semiconductor earnings as Samsung is the sole producer of processing chips used to power the iPhone and iPad, and also supplies Apple with mobile memory chips, NAND flash and display screens.

The Afghan Taekwondo team, for instance, has medaled in some international competitions, and now its athletes are training for the Olympics in Korea.
